WAIVER AND RELEASE OF LIABILITY AGREEMENT

PLEASE READ CAREFULLY! BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT.

1. Acknowledgment of Risks I understand that participating in pickleball and any other activities at The Lab (the “Company”) involves inherent risks, including but not limited to physical injuries, such as sprains, fractures, concussions, or even death. I also understand that these risks may be caused by my actions, the actions of others, the conditions of the facility, or the equipment used. I fully accept and assume all such risks and responsibility for any losses, costs, or damages I incur as a result of my participation in any activities at The Lab.

2. Assumption of Risk I voluntarily agree to participate in the activities offered by The Lab and acknowledge that I am assuming all risks, including but not limited to those outlined above. I understand that The Lab strongly recommends consulting with a physician before participating in any physical activities and that it is my responsibility to ensure that I am physically and mentally fit to participate.

3. Release of Liability In consideration of being allowed to participate in the activities at The Lab, I hereby release, discharge, and hold harmless The Lab, its owners, employees, agents, instructors, contractors, and other participants (the “Released Parties”) from any and all claims, actions, damages, liabilities, costs, or expenses, including attorneys' fees, arising out of or in any way connected to my participation in the activities or use of The Lab's facilities, including claims based on the Released Parties’ negligence or any other legal theory. This release does not apply to claims resulting from intentional misconduct by the Released Parties.

4. Indemnification I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, damages, liabilities, costs, or expenses (including attorneys' fees) arising out of or related to my participation in the activities at The Lab or any breach of this Agreement.

5. Use of Facilities and Equipment I agree to use The Lab's facilities and equipment in a safe and responsible manner. I understand that I am responsible for any damage I cause to the facilities or equipment and agree to reimburse The Lab for any costs incurred as a result of such damage.

6. Medical Treatment In the event of an emergency, I consent to receiving any medical treatment deemed necessary by The Lab staff or emergency personnel. I understand that The Lab does not provide medical insurance and that I am responsible for any medical costs incurred as a result of my participation.

7. Photo and Video Release I grant The Lab permission to use any photographs, videos, or other media taken of me during my participation in activities at The Lab for promotional purposes, without compensation or further notice.

8. Governing Law and Venue This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas. Any disputes arising from this Agreement shall be resolved exclusively in the courts of Travis County, Texas.

9. Severability If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Acknowledgment of Understanding I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
